Judge refuses to block part of Proposition 314 aimed at curbing illegal immigration

ARIZONA:- A federal judge has decided not to block state officials, for the time being, from implementing a portion of a voter-approved measure aimed at curbing illegal immigration.

After approximately 90 minutes of arguments and a brief recess, Judge Michael Liburdi ruled that the claims made by an immigrant advocacy group—asserting that the implementation of ‘Proposition 314’ would cause them irreparable harm—were based merely on speculation.

A provision of the newly implemented rule—approved by public vote—classifies illegal entry into Arizona from another country as a misdemeanor and empowers state judges to issue deportation orders.

Immigrant advocacy groups argue that this measure violates the constitutional “supremacy clause,” which grants the federal government broad authority over immigration matters.

It is reported that hearings regarding that specific aspect of the case will continue.
