Federal court case filed against Secretary of State Rubio demanding resumption of DV lottery

LOS ANGELES:- A California-based law firm filed a lawsuit in federal court on Wednesday, seeking to compel Secretary of State Marco Rubio to open the registration process for the 2027 Diversity Visa program.

Red Eagle Law claims that the State Department’s continued inaction has increased the risk that the program—authorized by the U.S. Congress—will fail to be implemented.

Even as the fiscal year draws to a close on September 30, the State Department has not yet announced the registration dates for DV-2027. This has left prospective applicants wishing to participate in the Diversity Visa program uncertain about whether they will be able to enter the green card lottery.

Red Eagle Law, L.C. filed a complaint on August 19 in the U.S. District Court for the Southern District of California. The case, *Red Eagle Law, L.C. v. Rubio*, is docketed as No. 3:26-cv-04738-JO-VET. The case has been assigned to U.S. District Judge Jinsook Ohta and U.S. Magistrate Judge Valerie E. Torres. A summons was issued to the defendant on the same day.

The law firm has asked the court to declare unlawful Rubio’s failure to implement the Diversity Visa program for the 2027 fiscal year and to order the State Department to designate a registration period of at least 30 days in September.

Attorney Curtis Morrison of Red Eagle Law stated that he plans to file an ex parte application on Friday seeking a temporary restraining order and immediate court intervention.
