Hearing on writ petition against trade union dissolution on June 12

KATHMANDU:- Hearing on the writ petition filed against the government’s decision to dissolve the employees’ trade union will continue on June 12.

The hearing was held today before the constitutional bench of Chief Justice Dr Manoj Kumar Sharma, Justices Dr Nahakul Subedi, Binod Sharma, Abdul Aziz Musalman and Mahesh Sharma Poudel; it could not be completed today and was rescheduled to be held on June 12.

Earlier, the constitutional bench chaired by the then Acting Chief Justice Sapana Pradhan Malla, Justices Kumar Regmi, Hari Prasad Phuyal, Binod Sharma, and Sharanga Subedi, had given a divided opinion on the matter.

The then Acting Chief Justice Malla, Justices Regmi and Phuyal had decided to issue a short-term interim order not to implement the government’s decision, while Justices Binod Sharma and Sharanga Subedi noted a different opinion, arguing that there was no need for a short-term order as irreparable damage would not be caused by the government’s decision.

On behalf of the Central Working Committee of the Nepal Civil Servants Association, Chairperson Bhawani Dahal had filed the writ petition demanding an order cancelling the government’s decision to dissolve the trade unions.
